GENERIC CONTEST RULES
FOR LIVE, RADIO, TV, FACEBOOK, INSTAGRAM AND TWITTER
These Generic Contest Rules apply to all contests operated by CBC live, on-‐air on CBC Radio or TV throughout Canada, or on-‐line, including on www.cbc.ca (the “Website”) and where you can enter or participate in a CBC-‐branded contest or giveaway via Facebook, Instagram, Twitter or any other third party service, application or website (a “Third Party Service”), except where there are specific rules for a particular contest (a “CBC Contest”).
By entering a CBC Contest, you agree to be bound by these Generic Contest Rules. Any submissions you make will be deemed to be “Your Content” and subject to the Your Content Submission Guidelines under the cbc.ca Terms of Use available at http://www.cbc.ca/aboutcbc/discover/submissions.html. Details of the prize(s) available to be won, the start and end dates and/or times, and any other information relevant to entering, participating or winning will be identified on the Website, via the CBC representative, on-‐air host and/or Third Party Service, as applicable, for each CBC Contest.
Unless otherwise stated for any CBC Contest, there is a limit of one entry per person per day during the contest period.
Unless otherwise stated, CBC Contests are open to all Canadian residents who have reached the age of majority in their province or territory of residence. If the contest states that it is open to minors, for any contestant who has not reached the age of majority, parent or guardian consent is necessary to enter a CBC Contest. Where appropriate, the terms “contestant” and “winner” mean parent or guardian of that person.
There is no purchase necessary to enter a CBC Contest. If the form of entry requires you to take any action such as enrolling as a member of a social media site and you do not wish to do this, an alternate entry mechanism is available by emailing promo@cbc.ca or such other email as provided on the Website. If entries via a Third Party Service and required contact information cannot be seen or accessed by CBC, the entry will not be eligible for the Contest. Check to ensure that the appropriate Third Party Service privacy/visibility settings are used for your entry.
Employees of CBC, such employees’ immediate family (father/mother, brother/sister, son/daughter) or persons living under the same roof are not eligible to enter any CBC Contest.
To enter for a chance to win a CBC Contest, follow the instructions given by the CBC representative, on the Website, via the Third Party Service, or by the on-‐air host (as applicable) to find out how to enter and be eligible to win a prize.
For CBC Radio call-in contests, you will be required to call in to the local radio station running that particular CBC Contest and follow the instructions of the on-‐air host oran employee that answers the phone. For contests where the winner is selected by a draw, a random draw will be made by a CBC representative from all qualifying entries made by the contest deadline. Selected contestant(s) will be contacted using the contact information provided at the time of entry (e.g. name, telephone number, email address, or social media account used) and may be announced publicly via Third Party Service. If you are a selected contestant and do not respond, or cannot be reached or qualified using the information provided at the time of entry within three (3) business days (or such other time as notified on the Website or on-‐air), incorrectly answer the mathematical skill testing question, decline the prize, or fail to return any required release form, the prize shall be forfeited and CBC has the right, at its sole discretion, to select another winner.
If you are found tampering with or abusing any aspect of a CBC Contest, including but not limited to acting in violation of these Rules, attempting to participate in a CBC Contest more than the maximum number of times allowed, attempting to participate in a CBC Contest with multiple accounts on the same social media platform, or acting with the intent to disrupt the normal operation of a CBC Contest, as determined by CBC, you will be disqualified. The discovery of any use of robotic, automatic, macro, programmed, third party or like methods to participate in a CBC Contest will void your attempted participation effected by such methods and you will be disqualified in CBC's sole and absolute discretion.
For giveaways or any other CBC Contest where the winner is responsible for picking up the prize, the prize must be picked up within 30 days or it shall be forfeited and CBC has the right, at its sole discretion, to select another winner. To be declared a winner, the selected contestant must first correctly answer a mathematical skill-‐testing question. Potential winners may be required to provide their full name and contact information and to furnish proof of identification. Winner(s) may also be required to sign a release declaring their eligibility as stipulated in these rules and releasing CBC, any sponsor or prize donor and their directors, officers and employees (the “Contest Parties”) from all liability for any damage or loss arising from participation in the contest or from the awarding, acceptance or use of the prize. If a release is not provided, acceptance of the prize will be deemed to release the Contest Parties from all liability for any damage or loss arising from participation in the contest or from the awarding, acceptance or use of the prize.
Prizes shall be accepted as is and may not be exchanged or refunded for an amount of money, sold or transferred. No substitutions will be allowed. Any unused portion of a prize will be forfeited.
If the prize cannot be awarded as described, CBC reserves the right to substitute a prize or prize component with another of comparable value, as determined in its sole discretion. Refusal to accept the prize releases the Contest Parties from any obligation toward the winner.
Your entry will become the property of CBC and will not be returned to you. You declare that Your Content is legal, particularly with regard to compliance with copyright, rights to image, reputation and privacy, the Criminal Code and any other legislation applicable in such matters. You also declare that you hold the rights to Your Content and have consent from any people appearing in Your Content (including parental consent for minors) and all authorizations required to grant the licence specified hereafter to CBC. You agree to comply with standards of proper conduct in Your Content, as specified in the Submission Guidelines available on the cbc.ca site. CBC reserves the right to decide whether to use Your Content, in its sole discretion.
By submitting Your Content, you grant CBC a royalty-‐free, perpetual, non-‐exclusive, irrevocable, unrestricted, worldwide licence to publish, reproduce and distribute Your Content in all media, on all digital platforms and by any other means of communication controlled or authorized by the CBC, with or without credit or attribution to you and without cost. You waive all moral rights to Your Content and authorize CBC to use your name, picture and voice, where applicable, in conjunction with the use of Your Content. Collective agreement provisions may apply.
If you make any false statement, you will be automatically disqualified from the Contest.
Winners agree that CBC may use their name, image and/or voice for advertising purposes related to a CBC Contest free of charge.
CBC and the Third Party Service assume no liability for any loss, damage or injury, including without limitation: (i) lost, stolen, delayed, damaged, misdirected, late, destroyed, illegible or incomplete entries; (ii) loss, theft or damage to software or computer or telephone data, including any breach of privacy; (iii) fraudulent calls; (iv) inability of any person to participate in the Contest for any reason including mistaken addresses on mail or e-‐mail; technical, computer or telephone malfunctions or other problems with computer on-‐line systems, servers, access providers, computer equipment, or software; congestion on the internet or at any website, or any combination of the foregoing; (v) damage to any person’s computer, including as a result of playing or downloading any material relating to the Contest; (vi) any delay or inability to act resulting from an event or situation beyond their control, including a strike, lockout or other labour dispute at their location or the locations of the organizations and businesses whose services are used to administer the CBC Contest; (vii) any injury, damage or loss arising from participation in the CBC Contest or from the awarding, acceptance or use of any prize, or (viii) prizes that are lost, damaged or misdirected during shipping.
CBC reserves the right to cancel or suspend the CBC Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the CBC Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the CBC Contest is a violation of criminal and civil laws. Should such an attempt be made, CBC reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
All personal information, such as name and contact information, required to enter a CBC Contest is collected by CBC solely for the purposes of administering the CBC Contest and as otherwise set out herein or by the CBC representative, on the Website, via the Third Party Service, or by the on-‐air host and shall not be used by CBC forany other purpose without your express consent. When the Contest allows entry via Third Party Service, you understand that any personal information you share as well as Your Content will be subject to the Terms of Use and Privacy Policy of that Third Party Service.
CBC Contests are not sponsored or endorsed by the Third Party Service. By entering any CBC Contest, all contestants release CBC and all Third Party Services, as well as their directors and officers, from any liability in connection with such CBC Contest.
If the identity of a contestant is disputed , the authorized account holder of the e-‐mail address submitted or the social media account used at the time of entry will be deemed to be the contestant. A selected contestant may be required to provide proof identity, including that (s)he is the authorized account holder of the e-‐mail address orsocial media account associated with the selected entry. All entries must be submitted from a valid e-‐mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in the CBC Contest will be the Contest server.
CBC reserves the right to amend the Contest Rules or to terminate any CBC Contest at any time without any liability to any contestant.
The decisions of CBC with respect to any dispute or issue involving a CBC Contest are final and binding on all contestants.
